Terms of Sale

1. The contact between us

We must receive payment of in full for the Goods that you order prior to the acceptance of your order. Our acceptance of such order brings into existence a legally binding contract between us.

2. Availability

All orders are subject to acceptance and availability. Should the Goods be unavailable from stock, we will contact you by e-mail. You will have the option either to wait until the item is available from stock or to cancel your order.

3. Price

The prices payable for Goods are as set out in our website. All prices are subject to VAT at the current rate and are correct at the order date.

4. Payment Terms

We will charge your account for payment upon receipt of your order. If your order is rejected then a full refund will be made. We accept no liability if a delivery is delayed because you did not give us the correct payment details. If it is not possible to obtain full payment for the Goods from your account then we reserve the right to cancel the contract and/or suspend any further deliveries to you. This does not affect any other rights we may have.

5. Delivery Charges

Additional delivery charges may be applicable for addresses in the Isle of Wight, the Isle of Man, the Scottish Isles, parts of Scotland, Northern Ireland and the Channel Isles. Call us for further details.

6. Delivery

  • Delivery will be made Monday to Friday (excluding public holidays) to ground floor locations only.
  • Deliveries can only be made to addresses within the United Kingdom. It is your responsibility to ensure deliveries can be made to your specific address.
  • It is your responsibility to ensure that all address details are entered correctly. Any changes made to the delivery address may result in additional administrative charges.
  • Once a delivery date is scheduled, you must ensure that someone is available at the said address to accept the delivery. Should our agent be unable to complete the delivery for this reason, you may incur a second delivery charge.
  • Combat Warm Air Heaters Direct accept no liability for any loss or damage to Goods once they are delivered in accordance with your instructions. Delivery dates are scheduled but times cannot be guaranteed. If delivery is delayed through circumstances beyond our control, an alternative delivery date will be agreed upon.
  • All Goods must be inspected carefully for any signs of damage or shortage prior to acceptance of delivery. In the unlikely event of any damage or shortage, you have the option to refuse delivery, or accept and sign the delivery note as damaged Goods.
  • Once delivery is made (and payment is received in full) ownership will pass to you. Goods will be held at your own risk and we cannot be held liable for any loss or damage thereto.
  • It is imperative that you do not book an installer until you have full ownership of the Goods. Combat Warm Air Heaters Direct are not liable for any installer/Contractor costs incurred by you, nor any consequential loss or compensation in this regard.

7. Risk and ownership

Risk of damage to loss of the Goods passes to you at the time of delivery to you, or attemped delivery at the agreed time. Ownership of the Goods will only pass to you once payment is received by us in full.

8. Acknowledgement and acceptance of your order

You will need to provide us with your e-mail address whereupon you will be notified by e-mail as soon as possible to confirm receipt of your order. Acceptance of your order will be provided on despatch of the Good(s) ordered.

9. Cancellation rights

  • If Goods are received prior to cancellation of your contract then you must return the Goods back to the address supplied at your own cost and risk. It is recommended you take out insurance on the Goods against damage or loss.
  • If you cancel your contract but we have already processed the Goods for delivery you must not unpack the Goods when they are received and you must return the goods back to the address supplied at your own cost and risk as soon as possible. It is recommended you take out insurance on the Goods against damage or loss.

10. Returns

All returns to us must be received in perfect condition with the packaging undamaged. You have a statutory duty to restore received Goods to us and/or to store them and take reasonable care of them. As such we recommend you take out insurance on the Goods against damage or theft.

11. Cancellation by us

We hereby reserve the right to cancel the contract between us if:

  • We have insufficient stock to honour delivery of the goods;
  • Delivery is not possible to the address specified.
  • One or more of the Goods you ordered was listed at an incorrect price due to a typographical error, or an error in the pricing information received by us from our suppliers.

In the event that we do cancel your contract we will notify you by e-mail as soon as possible but in any event within 30 days of such cancellation your account will be re-credited in full.

12. Liability

You must notify us in writing if Goods are not received within 30 days of order, unless this is not reasonably practicable. Such notification must be received within 60 days of order for Combat Warm Air Heaters Direct to have any liability to you.
